Certification of Assurances
|

As a recipient of federal funds, the University of Tulsa certifies that it is in
compliance with all federal assurances listed below, as applicable.
- Animal Welfare (Public
Law 99-158)
-If warm-blooded animals are to be used in the research,
The University of Tulsa shall comply with the applicable portions of the Animal
Welfare Act (PL-89-544 as amended) and shall adhere to the various
guidelines prescribed in "Guide for Care and Use of Laboratory Animals
" (NIH Publication No. 86-23 REV 1985), and the Public Health Service
Policy on Humane Care and Use of Laboratory Animals, revised 9/86.+
- Certification Regarding Lobbying (Section
1352, Title 31 of the U.S. Code)
-Contractors who apply or bid for an award of $100,000 or
more shall file the required certification. Each tier certifies to the
tier above that it will not and has not used Federal appropriated funds to
pay any person or organization for influencing or attempting to influence an
officer or employee of any agency, a member of Congress, officer or employee
of Congress, or an employee of a member of Congress in connection with
obtaining any Federal contract, grant, or any other award covered by 31
U.S.C. 1352. Each tier shall also disclose any lobbying with
non-Federal funds that takes place in connection with obtaining any Federal
award. Such Disclosures are forwarded from tier to tier up to the
recipient.*
- Civil Rights and Equal Employment Opportunity (Executive
Orders 11246 and 11375)
-All contracts shall contain a provision requiring
compliance with E.O. 11246, "Equal Employment Opportunity," as
amended by E.O. 11375, "Amending Executive Order 11246 Relating to
Equal Employment Opportunity," and as supplemented by regulations at 41
CFR part 60, "Office of Federal Contract Compliance Programs, Equal
Employment Opportunity, Department of Labor."*
- The University of Tulsa shall comply with Title VI of the Civil
Rights Act of 1964 and Executive Order 11246 as amended.
- The University of Tulsa shall comply with Section 901 of Title IX
of the Education Amendments of 1972, as amended.
- The University of Tulsa comply with Section 504 of the
Rehabilitation Act of 1973, as amended.
- The University of Tulsa shall comply with the Age Discrimination
Act of 1975, as amended.+
- Debarment and Suspension (Executive
Orders 12549 and 12689)
-No contract shall be made to parties listed on the
General Services Administration's List of Parties Excluded from Federal
Procurement or Nonprocurement Programs in accordance with E.O.s 12549 and
12689, "Debarment and Suspension." This list contains the
names of parties debarred, suspended, or otherwise excluded by agencies, and
contractors declared ineligible under statutory or regulatory authority
other than E.O. 12549. Contractors with awards that exceed the small
purchase threshold shall provide the required certification regarding its
exclusion status and that of its principal employees.*
- Delinquent Federal Debt (OMB Circular No. A-129)
-The University of Tulsa shall certify that it is not
delinquent on repayment of any federal debt. If The University of
Tulsa is not able to certify this, an explanation shall be provided
and attached to the agreement.+
- Drug Free Schools and Communities Act Policy (34
CFR Part 86)
-Adopted by The University of Tulsa on September 5, 1990,
it represents The University of Tulsa's efforts to achieve compliance as a
federal contractor with The Drug-Free Schools and Communities.
- Freedom of Information Act (5
USC 552)
-On October 8, 1999, OMB published final revisions to
Circular A-110, "Uniform Administrative Requirements for Grants and
Agreements with Institutions of Higher Education, Hospitals and Other
Non-Profit Organizations," governing public access to certain research
data under the Freedom of Information Act.^
- Intellectual Property (Inventions and Patents) (37
CFR part 401)
-Contracts or agreements for the performance of
experimental, developmental, or research work shall provide for the rights
of the Federal Government and the recipient in any resulting invention in
accordance with 37 CFR part 401, "Rights to Inventions Made by
Nonprofit Organizations and Small Business Firms Under Government Grants,
Contracts and Cooperative Agreements," and any implementing regulations
issued by the awarding agency.*
- Misconduct in Science (42
CFR 50 Subpart A)
-The University of Tulsa must certify that it has
acceptable assurance for the dealing with and reporting of possible
misconduct in science on file with the Public Health Service, Office of
Scientific Integrity.+
- Protection of Human Subjects (45
CFR 46)
-To implement the principles of the Code of Federal
Regulations: Title 45 CFR Part 46, Protection of Human Subjects (revised
August 19, 1991), The University of Tulsa has developed a systematic policy
and a set of procedures to be followed in all investigations involving human
subjects, whether or not the project is federally funded. Every
application for financial support of research projects which involves the
use of human subjects must be reviewed first by a Peer Review Committee and
then by the Internal Review Board. The reviews be the Peer Review
Committee and the IRB are conducted to ensure that research activities
involving human subjects safeguard the rights and welfare of human subjects
as provided for in 45 CFR 46.
- Standards of Conduct for Employees (Conflict of Interest) (42
CFR 50 Subpart F)
-The University of Tulsa shall certify that it has a
written policy regarding any conflicts of interest that is compliant with
NSF Policy, Article 510 of the Grant Policy Manual. The Contractor additionally certifies that
he/she has a financial disclosure form on file
which has been completed for the principal project contact, and that if a
conflict is disclosed, The University of Tulsa will be notified.+
